Short answer
The Code does not exclude damages merely because a penalty exists. Assess the claims’ relationship, contractual terms and avoidance of double recovery. Actual loss needs a proper basis and evidence.
Practical example
Apartment delivery is late and the buyer pays additional rent. Claiming both contractual penalty and rent costs requires legal assessment.
What to do
Separate each claim’s basis and period. Keep receipts, causation evidence and mitigation steps. Remember the distinct rule on simultaneously claiming performance and a penalty.
Legal basis
Georgian Civil Code — Articles 394, 408, 412, 419. Checked on 28 October 2026. The outcome depends on the contract, facts and evidence.
