Short answer

Expiry of limitation does not automatically erase the debt’s factual existence. The Code entitles the debtor to refuse performance. Voluntary performance after expiry cannot be reclaimed merely because the claim was time-barred.

Practical example

A debtor pays an old debt and later learns of possible limitation. That alone does not justify recovering the payment.

What to do

Check when time began, partial payments, acknowledgments and court history. An old debt date alone is not a final limitation assessment.

Points to consider

An acknowledgment or payment may affect the running of time. Understand the consequences before signing an agreement.
