Short answer

Repayment may be available if no legal basis existed or it subsequently ceased. Establish first that there was no debt, gift, service payment or other justified basis.

Practical example

A debt is paid twice. The excess may be recoverable if the first discharge and second transfer are proved.

What to do

Prepare a payment chronology, obtain the agreement and explain the excess. Send the recipient a written demand and calculation.

Points to consider

The Code sets exceptions and rules governing the extent of restitution. Every transfer is not necessarily a repayable loan.
