Short answer

The maintenance duty arises from parenthood, not only divorce. Remaining legally married does not itself prevent a claim if a parent fails to contribute to necessary support.

Practical example

The parents remain married but live separately, and one pays everything. Maintenance can be addressed before divorce.

What to do

Prepare the birth certificate, actual expenses and payment history. Try a clear written agreement or consider a court claim if agreement fails.

Points to consider

Contact arrangements and maintenance are separate matters. Unilaterally stopping one because of the other is not a solution.
